Terms of Service

1. Acceptance of Terms

By accessing or using EVHubNI ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. These Terms apply to all users including buyers, private sellers, and dealers.

2. What EVHubNI Is

EVHubNI is an online marketplace platform that connects buyers and sellers of used electric and hybrid vehicles in Northern Ireland. EVHubNI is not a vehicle dealer, agent, or broker. We do not own, inspect, buy, or sell any vehicles listed on the platform.

All transactions are directly between the buyer and seller. EVHubNI is not party to any sale and accepts no liability for any transaction, vehicle condition, or dispute between users.

3. Account Registration

To list vehicles or save listings, you must create an account. You agree to:

• Provide accurate and truthful information when registering
• Keep your account details up to date
• Keep your password secure and not share it with others
• Notify us immediately at hello@evhubni.co.uk if you suspect unauthorised access
• Be responsible for all activity that occurs under your account

4. Seller Responsibilities

If you list a vehicle on EVHubNI, you confirm that:

• You are the legal owner of the vehicle or have the owner's authority to sell it
• All information in your listing is accurate, complete, and not misleading
• Photos and descriptions are genuine and represent the actual vehicle
• The vehicle is legally roadworthy or any defects are clearly disclosed
• The vehicle is free from any undisclosed finance, charges, or encumbrances
• You will respond to genuine buyer enquiries promptly and honestly
• You will remove or mark the listing as sold once the vehicle is sold

EVHubNI reserves the right to remove any listing that we believe contains false, misleading, or fraudulent information, without notice and without liability to the seller.

5. Buyer Responsibilities

If you enquire about or purchase a vehicle, you agree to:

• Conduct your own due diligence before purchasing any vehicle
• Arrange independent inspection of any vehicle before purchase if you have concerns
• Verify the vehicle's history, ownership, and finance status independently
• Not make false or misleading enquiries to sellers
• Understand that EVHubNI does not guarantee the accuracy of any listing information

6. Listing Moderation

All listings submitted by private sellers are reviewed before going live. EVHubNI reserves the right to approve, reject, edit, or remove any listing at our sole discretion including but not limited to listings that:

• Contain false, misleading, or fraudulent information
• Are not electric or hybrid vehicles
• Violate any applicable law or regulation
• Contain inappropriate, offensive, or irrelevant content
• Are duplicates of existing listings

7. VRT Information Disclaimer

EVHubNI provides a VRT Check Tool and VRT status information on listings as a guide only. This information is based on publicly available data from the DVLA and published Irish Revenue rules and is provided for informational purposes only.

EVHubNI does not guarantee the accuracy of VRT calculations or status information. VRT rules change regularly. You should always verify VRT liability directly with Irish Revenue or a qualified customs agent before importing any vehicle into the Republic of Ireland. EVHubNI accepts no liability for any VRT costs, penalties, or losses arising from reliance on our VRT information.

8. Battery Health and Range Data

Battery State of Health (SoH) figures and range estimates displayed on listings are provided by sellers and are not independently verified by EVHubNI unless specifically marked as verified. Real-world range figures are estimates only and will vary depending on driving style, conditions, temperature, and vehicle age. EVHubNI accepts no liability for any discrepancy between listed and actual battery health or range performance.

9. Prohibited Conduct

You agree not to:

• List vehicles you do not own or have authority to sell
• Post fraudulent, false, or misleading listings or enquiries
• Harass, threaten, or abuse other users
• Use the Service for any illegal purpose
• Scrape, data mine, or harvest data from the Service
• Attempt to gain unauthorised access to any part of the Service
• Use automated tools to access or interact with the Service
• Circumvent any security measures or access controls

10. Intellectual Property

All content on EVHubNI including text, design, logos, and software is owned by EVHubNI and protected by UK copyright law. You may not reproduce or use our content without express written permission.

By uploading photos or content to EVHubNI, you grant us a non-exclusive, royalty-free licence to display that content on the platform for the purpose of operating the Service. You retain ownership of your content.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. EVHubNI does not warrant that the Service will be uninterrupted, error-free, or that listings are accurate. We make no warranty regarding the quality, safety, legality, or title of any vehicle listed on the platform.

12. Limitation of Liability

To the maximum extent permitted by law, EVHubNI shall not be liable for:

• Any dispute, loss, or damage arising from a transaction between a buyer and seller
• Any inaccuracy in listing information provided by sellers
• Any VRT costs, import duties, or penalties incurred by buyers
• Any indirect, incidental, or consequential loss or damage
• Any loss arising from unauthorised access to your account
• Any interruption or unavailability of the Service

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

13. Governing Law

These Terms are governed by the laws of Northern Ireland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.

14. Changes to Terms

We may update these Terms at any time. Significant changes will be communicated to registered users by email. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
